SWB H.B. 2808 75(R)BILL ANALYSIS WAYS & MEANS H.B. 2808 By: Edwards 4-28-97 Committee Report (Unamended) BACKGROUND Currently, Section 42.29, Tax Code (Attorney's Fees), limits attorney's fees awarded for an ad valorem tax appeal. The fees may not exceed the total amount that the property owner's tax liability is reduced after an appeal. PURPOSE The bill eliminates the current limits that cap attorney's fees in certain appeals of ad valorem taxes of real property. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 42.29, Tax Code (Attorney's Fees), by eliminating attorney's fees limitations that are not to exceed the total amount by which the property owner's tax liability is reduced as a result of an appeal.
