SGN H.B. 2827 75(R)BILL ANALYSIS CORRECTIONS H.B. 2827 By: Place 4-2-97 Committee Report (Unamended) BACKGROUND The requirement that TDCJ report inmate deaths to the Attorney General's Office was inadvertently deleted last session. PURPOSE H.B. 2827, if enacted, would require the Texas Department of Criminal Justice to report inmate deaths, other than deaths attributable to natural causes or deaths due to legal execution, to the Attorney General's Office. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subsection (c), Article 49.18, Code of Criminal Procedure, by adding language to state that 49.18(b), CCP, does not apply to a death that occurs in a facility that is operated by or under contract to the Texas Department of Criminal Justice, if the death occurs under circumstances outlined in Section 501.055(b), Government Code. SECTION 2. Applies only to the death of an inmate that occurs on or after the effective date of the Act. SECTION 3. Emergency clause.
