SLC C.S.H.B. 2833 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT C.S.H.B. 2833 By: Gallego 4-21-97 Committee Report (Substituted) BACKGROUND The Texas Low-Level Radioactive Waste Disposal Authority was created by the Texas Legislature to select, locate, and operate a site for the disposal of Texas' low-level radioactive waste. By statute, the authority may purchase land for use in the disposal of waste. However, no provision is made to allow the Authority to dispose of land which is not needed to fulfill the mission of the agency. PURPOSE HB 2297 will allow the Texas Low-Level Radioactive Waste Disposal Authority to sell, exchange, donate, convey or otherwise dispose of real property that is not part of a licensed disposal facility. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Sec. 402.094, Health and Safety Code, is amended by adding Subsection (a) and adding Subsection (e) as follows: (a) By allowing the authority to exchange land for use in the construction and operation of a disposal site. (e) Allows the authority to sell, exchange, donate, convey property that is not part of a licensed disposal facility SECTION 2. Emergency clause COMPARISON OF ORIGINAL TO SUBSTITUTE CSHB 2833 states in (e) that the Tx Low-Level Radioactive Waste Disposal Authority may sell , exchange, donate, or convey, property that is not part of a licensed disposal facility. The original legislation included the words encumber or otherwise dispose of, the CSHB 2833 does not contain such language.
