DIGEST 

Currently, Section 106.13, Alcoholic Beverage Code, contains language
which can be misinterpreted as indicating this section, by itself, is not
a separate violation of the code. This bill sets forth sanctions against
sellers of alcoholic beverages for violations relating to minors.  
 
PURPOSE

As proposed, H.B. 2861 sets forth sanctions against sellers of alcoholic
beverages for violations relating to minors.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 106.13(a), Alcoholic Beverage Code, to authorize
the Alcoholic Beverage Commission (commission) to cancel or suspend for
not more than 60 days a retail license or permit or a private club
registration permit under certain conditions.  Deletes the words "in
violation of this code" from a provision regarding a licensee or permittee
with criminal negligence who has sold, served, dispensed, or delivered an
alcoholic beverage to a minor.     

SECTION 2. Provides the the change in law made by this Act applies to all
retail licenses and permits, private club  registration permits, and food
and beverage certificates issued by the Texas Alcoholic Beverage
Commission. 

SECTION 3. Effective date: September 1, 1997.

SECTION 4. Emergency clause.
