DIGEST 

Currently, no statute exists granting any commissioners court authority to
require the preparation of a county master drainage plan.  This bill sets
forth provisions regarding a master drainage plan for certain counties.

PURPOSE

As proposed, H.B. 2868 sets forth provisions regarding a master drainage
plan for certain counties.  
RULEMAKING AUTHORITY

Rulemaking authority is granted to SECTION 1 (Sec.  411.007(b), Local
Government Code) of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 411, Local Government Code, by adding Section
411.007, as follows: 

Sec.  411.007.  MASTER DRAINAGE PLAN FOR CERTAIN COUNTIES.  Provides that
this section only applies to a county that has a certain population or
operates a certain road department system.  Authorizes the commissioners
court to require the county road engineer to prepare and coordinate a
county master drainage plan.  Authorizes the commissioners court by order
to adopt regulations to implement the county master drainage place.   

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
