SCT H.B. 2892 75(R)BILL ANALYSIS STATE FEDERAL & INTERNATIONAL RELATIONS H.B. 2892 By: Janek 4-22-97 Committee Report (Unamended) BACKGROUND Current law allows cities to use Certificates of Obligation to demolish dangerous structures as a tool to combat neighborhood blight. Occasionally, historic structures are in disrepair and cities have no other options other than demolition. PURPOSE HB 2892 would allow cities to use Certificates of Obligation to restore and resell historic structures that have fallen into disrepair. RULEMAKING AUTHORITY It is the opinion of this Committee that this bill does not delegate any additional rulemaking authority to any state agency, department, office of institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 271.0461, Local Government Code, to allow municipalities to use Certificates of Obligation to restore historic structures. SECTION 2. Amends Section 442.001, Government Code, to add a new (6th) definitions to what is considered a "historic structure". The new definition would allow municipalities with a historic preservation ordnance to designate certain structures as historic. SECTION 3. Emergency Clause.
