TWT H.B. 2964 75(R)BILL ANALYSIS TRANSPORTATION H.B. 2964 By: Sadler 4-5-97 Committee Report (Unamended) BACKGROUND The 1947 Special Road law for Panola County was created by the 50th Legislature's passage of Senate Bill 367. This law set up a road law similar to the "Unit System" also made available to any county by another 1947 law. However, Panola County has been under the assumption that they operate under what is codified as V.T.C.A. Transportation Code, Chapter 252, Subchapter D, "County Road Department System." They recently learned that this is not true, but rather they are still under the Special Road Law. To repeal the Special Road Law for Panola County would leave the County under the Transportation Code. The 1947 Special Law is not codified; it is found only in the Session Laws. PURPOSE To place Panola County under the Transportation Code, Chapter 252, Subchapter A, thus repealing the Special Law of 1947 that included Panola County. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repeals Chapter 117, Acts of the 50th Legislature, Regular Session, 1947. SECTION 2. Amends Section 252.101(a), Transportation Code, by removing Panola County from the list of counties to which the subchapter does not apply. SECTION 3. Amends Section 252.201(a), Transportation Code, by removing Panola County from the list of counties to which the subchapter does not apply. SECTION 4. Effective date -- September 1, 1997. SECTION 5. Emergency Clause.
