SRC-JFA H.B. 3016 75(R) BILL ANALYSIS Senate Research Center H.B. 3016 By: Price (Galloway) State Affairs 5-12-97 Engrossed DIGEST On January 3, 1990, Jefferson County, Texas, transferred 689.69 acres of land to the Texas Department of Criminal Justice (TDCJ) that now serves as the site for several correctional facilities. The Mark W. Stiles Unit, Gist State Jail and Le Blanc Substance Abuse Unit were eventually built on this property. Jefferson County, Texas, wishes to regain title to 72.96 acres of this land which is a proposed site for a local juvenile justice facility. TDCJ has determined that this 72.96 acres of land is not essential to the agency's operations. TDCJ does not have the authority to exchange its land for other land or give its land away. This bill would allow TDCJ to transfer the land to Jefferson County. In exchange, Jefferson County would deed an equivalent amount of land to TDCJ. PURPOSE As proposed, H.B. 3016 transfers certain state property from the Texas Department of Criminal Justice to Jefferson County, Texas. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Requires the Texas Department of Criminal Justice (TDCJ) to donate and transfer to Jefferson County the real property described by Subsection (d). Requires TDCJ to transfer the property by an appropriate instrument of transfer. Requires the instrument to include certain provisions. Requires TDCJ to retain custody of the instrument of transfer after its filing. Sets forth the description of the land referred to in Subsection (a). SECTION 2. Emergency clause. Effective date: upon passage.
