SLC H.B. 3016 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 3016 By: Price 4-17-97 Committee Report (Unamended) BACKGROUND On January 3, 1990 Jefferson County, Texas transferred 689.69 acres of land to the Texas Department of Criminal Justice (TDCJ) that now serves as the site for several correctional facilities. The Mark W. Stiles Unit, Gist State Jail and Le Blanc Substance Abuse Unit were eventually built on this property. Jefferson County, Texas wishes to regain title to 72.96 acres of this land which would be an ideal site for a local juvenile justice facility. Additionally, TDCJ has determined that this 72.96 acres of land is not essential to the agency's operations. However, TDCJ does not have the authority to exchange its land for other land or give its land away. PURPOSE HB 3016 allows TDCJ to transfer land and demonstrate a continued willingness to aide local government whenever possible. In exchange, Jefferson County will deed an equivalent amount of land to the TDCJ. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. (a) Grants authority to TDCJ to donate and transfer the property to Jefferson County. (b) Describes the procedure by which the property will be transferred and the requirements for future use of the land including the disposition of the land if it is not used for governmental purposes. (c) Provides for TDCJ to retain custody of the instrument of transfer after its filing. (d) The legal description of the 72.96 acres of land owned by TDCJ. This description was prepared by a survey conducted by a registered land surveyor. SECTION 2. Emergency Clause.
