SLC H.B. 3029 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 3029 By: Olivo 4-18-97 Committee Report (Unamended) BACKGROUND Chapter 203, Property Code, deals with the enforcement of land use restrictions. This chapter authorizes the county attorney to enforce deed restrictions in counties with a population of more than two million. PURPOSE HB 3029 seeks to lower the bracket from counties with population of more than two million to counties of population of more than two hundred thousand. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. The heading to chapter 203, Property Code, is amended to read as follows: CHAPTER 203. ENFORCEMENT OF LAND USE RESTRICTIONS IN CERTAIN COUNTIES. SECTION 2. Amends Sec. 203.001, Property Code, as follows: Sec. 203.001. APPLICABILITY OF CHAPTER. States that this chapter applies only to counties with a population of more than 200,000. SECTION 3. Emergency clause.
