IMF H.B. 3048 75(R)BILL ANALYSIS STATE AFFAIRS H.B. 3048 By: Hodge 5-2-97 Committee Report (Unamended) BACKGROUND As proposed, H.B. 3048 would add discrimination by religion or age in the definition of unlawful employment practice to correct a mistake in the drafting of the original legislation passed last session. The original proposed draft, included "religion, age" in both the first and second clauses of Section 21, 125(a). The legislation that became law contained the language in the first clause only. This change would also conform the state employment discrimination statutes with federal law. PURPOSE This amendment to Section 21.125(a) of the Texas Labor Code would include "religion, age" to the second clause of the sentence to conform to the first clause which reads "race, color, sex, national origin, religion, age, or disability." RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 21.125(a) of the Labor Code to include discrimination by religion or age in the definition of unlawful employment practice. SECTION 2. Effective date: September 1, 1997. Makes this Act prospective. SECTION 3. Emergency clause.
