PMWJ H.B. 3104 75(R)BILL ANALYSIS JUDICIAL AFFAIRS H.B. 3104 By: Craddick 4-16-97 Committee Report (Unamended) BACKGROUND In previous legislation passed last session, amendments to the Texas Government Code included the creation of the 385th Judicial District but failed to authorize the judge of the 385th District Court to appoint a bailiff and for the bailiff to receive compensation. PURPOSE This bill would ensure that the judge of the 385th District Court is entitled to appoint a bailiff and that the bailiff is entitled to receive compensation. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1 amends Section 53.002(a), Government Code to include the 385th District Court in the list of Midland County District Courts with authority to appoint a bailiff. SECTION 2 adds the 385th District Court to Section 53.007(a)(1), Government Code, which requires the sheriff to deputize the bailiffs for the courts listed. SECTION 3 amends Section 53.008, Government Code to include the 385th District Court bailiff in the list of bailiffs required to swear an oath administered by the judge. SECTION 4 amends Section 53.009(b), Government Code to include the 385th District Court bailiff in the list of bailiffs entitled to receive compensation set by the judge and paid by the county.
