BACKGROUND 

Sex offenders convicted after September 1, 1995, are required to register
with local law enforcement authorities within seven days of moving into a
new community.  The local law enforcement agencies are then required to
place a one day add in the legal notices section of the local newspaper.
This add contains the offender's age, gender, a brief description of the
offense, municipality, street name, and zip code of the offender's new
place of residence. 

PURPOSE

To add the sex offender's full name, address, and recent photograph to the
list of items that are published in a newspaper when they are released
into a community. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1 Section 3(f), Article 625-13c.1, Revised Statues, requires local
law     enforcement to provide additional information regarding sex
offenders to     newspapers for publication.  This information includes
the person's full name, age,   gender, description of the offense,
municipality, numeric street address, or   physical address if numeric
address is unavailable, zip code, and a recent     photograph. 

SECTION 2 Amends Section 4(g), Article 6252-13c.1, Revised Statutes,
requires local law   enforcement to provide additional information
regarding sex offenders to     newspapers for publication.  This
information includes the person's full     name, age, gender, description
of the offense, municipality, numeric street   address, or physical
address if numeric address is unavailable, zip code,     and a recent
photograph. 

SECTION 3 Section 5(b), Article6252-13c.1, Revised Statutes, states that
information contained in the database is public information, except for
the   person's social security number, driver's license number, telephone
number, or any   information that might identify the victim of the
person's offense. 
 
SECTION 4 Effective Date: September 1, 1997.

COMPARISON OF ORIGINAL TO SUBSTITUTE

SECTION 1 Section 3(f)(3) adds a provision that a physical address will be
provided in the   absence of a numeric street address. 

SECTION 2 Section 4(g)(3) makes changes identical to those in Section
3(f)(3). 

SECTION 3 This section is added in the substitute.  Subsequent sections
are renumbered.
