DIGEST 

Currently, no provisions relate to student participation in the selection
or retention of food service providers at institutions of higher
education.  This bill establishes provisions relating to student
participation in the selection or retention of food service providers at
institutions of higher education. 

PURPOSE

As proposed, H.B. 3125 establishes provisions relating to student
participation in the selection or retention of food service providers at
institutions of higher education. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 51Z, Education Code, by adding Section 51.945,
as follows: 

Sec. 51.945. STUDENT PARTICIPATION IN SELECTION OF FOOD SERVICE CONTRACTS.
Requires the governing board of an institution of higher education to
develop and implement policies that provide the students at an institution
of higher education (institution) with a reasonable opportunity to appear
before any committee or other entity that is determining whether a food
service provider shoud be selected or retained by the institution.
Requires the policies to provide the students with a reasonable
opportunity to discuss the performance of a food service provider and the
students' recommendations for qualifications of food service providers.
Requires a contract between an institution and a food service provider to
require the food service provider to periodically hold meetings or forums
to provide the students at the institution with a reasonable opportunity
to discuss the performance of the food service provider.  Defines "food
service provider," "governing board" and "institution of higher
education." 

SECTION 2. Effective date:  September 1, 1997.
  Makes application of this Act prospective.

SECTION 3. Emergency clause.
