PAK C.S.H.B. 3157 75(R) BILL ANALYSIS STATE AFFAIRS C.S.H.B. 3157 By: Hilbert 5-9-97 Committee Report (Substituted) BACKGROUND Current state law exempts a draft or working paper involved in the preparation of proposed legislation from open records law. PURPOSE As proposed, C.S.H.B. 3157 would exclude internal bill analyses or working papers prepared or collected by the governor's office for the purpose of evaluating proposed legislation from open records law. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 552.106 of the Government Code to exclude an internal bill analysis or working paper prepared or collected by the governor's office for the purpose of evaluating proposed legislation. SECTION 2. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE In SECTION 1 (Section 552.106) the substitute adds the word "internal" to the description of the type of bill analyses or working papers allowed to be excluded from open records law.
