The commissioners court of Galveston County wishes to propose to the citizens of Galveston County that the Beach Park Board of Trustees (board) for Texas counties bordering on the Gulf of Mexico be dissolved and the assets accrue to the county. This bill sets forth provisions regarding the dissolution of the board. PURPOSE As proposed, H.B. 3224 sets forth provisions for the dissolution of the Beach Park Board of Trustees. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 62, Natural Resources Code, by adding Subchapter F, as follows: SUBCHAPTER F. DISSOLUTION OF BOARD. Sec. 62.161. ORDER CALLING ELECTION TO DISSOLVE; NOTICE OF ELECTION. Authorizes the commissioners court to order an election to dissolve the Beach Park Board of Trustees (board) for Texas counties bordering on the Gulf of Mexico. Requires the commissioners court to give notice of the election. Requires the notice to contain certain information, and to be published in a certain newspaper for a certain period of time. Sec. 62.162. ELECTION TO DISSOLVE. Sets forth provision regarding an election to dissolve the board. Sec. 62.163. ADMINISTRATION OF PROPERTY, DEBTS, AND ASSETS AFTER DISSOLUTION. Sets forth provisions outlining the board's responsibilities after dissolution. Requires the commissioners court to enter an order dissolving the board after certain conditions are fulfilled. Provides that each trustee is discharged from liability under the trustee's bond on entry of the dissolution order. Provides that an employee or contract of the board becomes an employee or contract of the county, acting by and through its commissioners court, on entry of a dissolution order. SECTION 2. Emergency clause. Effective date: upon passage.
