BACKGROUND 

Chapter 62 of the Natural Resources Code makes possible the creation of a
Beach Park Board of Trustees for Texas counties bordering on the Gulf of
Mexico. The Board is created by a vote of the people in the county.
Galveston County is the only county in the State which has this type of
parks board.  

The statute currently has no provision for the dissolution of the created
board. The Commissioners Court of Galveston County wishes to propose to
the citizens of Galveston County that the board be dissolved and the
assets accrue to the County. The Commissioners Court is requesting that
the legislature provide for a process of dissolution that will include an
election similar to the one that initially created the body.  

All of the assets of the Galveston County Beach Parks Board were acquired
either by direct transfer when the board was first created or by
subsequent appropriation from the county budget. 

PURPOSE

To create procedures for an election to dissolve a beach park board of
trustees.   

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 62, Natural Resources Code, by adding
Subchapter F. DISSOLUTION OF BOARD. 

Sec. 62.161.  ORDER CALLING ELECTION TO DISSOLVE;  NOTICE OF ELECTION.
Gives the commissioners court the authority to order an election to
dissolve a beach park board.  Sets the requirements for notice of the
election;  information required in the notice; the length of time
necessary for publication; and timeframe for publication.    

Sec. 62.162. ELECTION TO DISSOLVE.  Procedures for the election are
specified.   
Sec. 62.163. ADMINISTRATION OF PROPERTY, DEBTS, AND ASSETS AFTER
DISSOLUTION.  Proscribes procedures for the transfer of power over the
administration and control of the property, debts, and assets.
