DIGEST 

Currently, railroads use contract carriers to move their employees from
the site of a crew change to the employees' home terminal.  Often the same
drivers for the contract carriers make several of these trips in a day
causing fatigue for the drivers.  There are concerns that these practices
create a hazardous situation for the drivers, the passengers, and the
general public travelling the highways. This bill requires the Department
of Public Safety to adopt safety rules for the operation of  certain
contract carriers  

PURPOSE

As proposed, H.B. 3252 establishes regulations for certain contract
carriers.   

RULEMAKING AUTHORITY

Rulemaking authority is granted to the Department of Public Safety in
SECTION 1 (Sec. 3A, Article 6675d, V.T.C.S.) of this bill.  

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Article 6675d, V.T.C.S., by adding Section 3A, as
follows: 

Sec.  3A.  REGULATION OF CONTRACT CARRIERS OF CERTAIN PASSENGERS. Provides
that this section applies only to a contract carrier transporting the
operating employees of a railroad on a road or highway of this state in a
vehicle designed to carry 15 or fewer passengers.  Requires the Department
of Public Safety to adopt rules regulating the operation of a contract
carrier to which this section applies.  Requires the rules to include
certain provisions. 

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
