BACKGROUND 

Section 312.619, Tax Code (Qualifications for Directors), sets forth
qualifications for a person to serve as a Director of a county development
district that person is at least 21 years of age, a resident citizen of
the State of Texas, and a qualified voter within the county in which the
district is located. Currently, there are no provisions barring someone
with a financial interest in the creation of a development district from
serving as a director. 

PURPOSE

This bill requires directors to submit personal financial statements and
signed affidavits stating that no personal vested interests exist in the
creation or expansion of a county development district, to the county
clerk, upon appointment and annually thereafter, continuing for 5 years
after their term. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.Section 312.618, Tax Code (Board of Directors), is amended by a
adding subsections (c) and (d): 

(c) provides that each director, upon appointment, shall submit a
financial statement that meets the requirements of Section 572.023,
Government Code (Public Access to Statements), to the county clerk
annually for the duration of his/her term and for five years after leaving
the board. 

  (d) provides that each director, upon appointment, will sign an
affidavit that he/she does not and will not have a vested interest in the
creation or expansion of the district for five years after leaving the
board. 

SECTION 2.Section 312.620, Tax Code (Persons Disqualified to Serve), is
amended by changing a section reference to take into account changes made
to  the Code during the 74th Legislature. 

SECTION 3.Effective date:  September 1, 1997.

SECTION 4.Emergency Clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

Adds language in SECTION 1 of this bill stating that each director, upon
appointment, will sign an affidavit that he/she does not and will not have
a vested interest in the creation or expansion of the district for five
years after leaving the board.  Also, the substitute alludes to a section
of the Government Code about "public access to statements."
