SRC-SLL H.B. 3330 75(R) BILL ANALYSIS Senate Research Center H.B. 3330 By: Talton (Patterson) Natural Resources 5-14-97 Engrossed DIGEST Drainage outfall ditch C106-03-00, in the southeast portion of Houston, is "owned" by three or four governmental agencies: city, county, state and transit authority. There have been difficulties establishing who is responsible for maintenance and repair of the ditch. This bill will set forth the ownership of a drainage outfall ditch in Harris County. PURPOSE As proposed, H.B. 3330 sets forth the ownership of a drainage outfall ditch in Harris County. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Provides that any easement or other ownership interest held by the Texas Department of Transportation, Harris County, the City of Houston, or any other state or local governmental entity in the drainage outfall ditch that has been designated by the Harris County Flood Control District (district) as Unit C106-03-00 and that runs from I45 (the Gulf Freeway) to Sims Bayou, in Harris County, is transferred to the district, and the district has authority over that drainage outfall ditch. Provides that the assumption by the district of authority over the drainage outfall ditch, including maintaining or repairing the ditch, is adequate and fair consideration for the ownership interests transferred to the district. SECTION 2. Effective date: September 1, 1997, and ownership interests in the ditch designated by the district as Unit C106-03-00 are transferred to and rest solely in the district on that date and thereafter. SECTION 3. Emergency clause.
