DIGEST 

Currently, the General Services Commission (commission) may not sell or
dispose of real property except as specifically authorized by the
legislature.  This bill expands the specific authority under which the
commission is allowed to sell or dispose of real property to include the
specific authority of the governor and the Legislative Budget Board, under
certain conditions.     

PURPOSE

As proposed, H.B. 3366 prohibits the General Services Commission from
selling or disposing of real property under certain conditions.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 2166.052(b), Government Code, to prohibit the
General Services Commission (commission) from selling or otherwise
disposing of real property except by specific authority granted by the
legislature if the legislature is in session or granted jointly by the
governor and the Legislative Budget Board if the legislature is not in
session. 

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
