SLC H.B. 3366 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 3366 By: Junell 4-14-97 Committee Report (Unamended) BACKGROUND Currently, the commission may not sell or dispose of real property except by specific authority of the legislature. Problems are created during the interim. This bill would increase the flexibility for timing of property disposition and improve the state's and GSC's ability to plan. PURPOSE HB 3366 would expand the specific authority under which the commission could sell or dispose real property to include the specific authority of the governor and Legislative Budget Board, if the legislature is not in session. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sec. 2166.052(b), Government Code, as follows: (b) Allow an additional exception whereby the commission may sell or dispose of real property upon the joint authority of the governor and the Legislative Budget Board, if the legislature is not in session. This exception is in addition to the existing exception granted by the specific authority of the legislature. SECTION 2. Effective Date: September 1, 1997. SECTION 3. Emergency clause.
