DIGEST 

Currently, the General Services Commission (commission) may hold title and
retain control of sites and buildings for the state in the municipality of
Austin.  In practice, the commission holds title to buildings in other
cities such as Houston, Waco, and Corpus Christi.  By removing the
denotation of Austin, the commission may hold and obtain title and retain
control of sites and buildings without reference to location.  This bill
will provide regulations regarding state buildings and the authority of
the commission to obtain title to and retain control of certain property
located outside Austin. 

PURPOSE

As proposed, H.B. 3367  provides regulations regarding state buildings and
the authority of the General Services Commission to obtain title to and
retain control of certain property located outside Austin. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Repealer: Section 2166.054(c), Government Code (Application of
this section to a state building constructed in Austin). 

SECTION 2. Amends Section 2165.005, Government Code, to require the
General Services Commission (commission) to submit the names proposed for
a new state building to be used as a state or regional headquarters by a
state agency, or proposals to rename an existing state building which is
used as a state or regional headquarters by a state agency, to the
presiding officers of the house of representatives and the senate.
Requires the commission to submit the names proposed for certain state
buildings to the presiding officers of the house of representatives and
the senate and the members of each body in whose district the building is
located.  Authorizes the name proposed by the commission for a state
building to be used as a local headquarters to be approved and authorized
only with the consent of the governor and the presiding officers of the
house of representatives and the senate.  Makes conforming changes. 

SECTION 3.  Effective date for Section 2165.005, Government Code, as
amended by this Act: September 1, 1997. 

SECTION 4. Makes application of this Act retroactive.

SECTION 5. Emergency clause.
  Effective date: upon passage.
