SLC H.B. 3367 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 3367 By: Junell 4-14-97 Committee Report (Unamended) BACKGROUND By existing statute, the commission may hold title and retain control of sites and buildings for the state in the municipality of Austin. In practice, the commission holds title to buildings in other cities such as Houston, Waco, and Corpus Christi. By removing the denotation of Austin, the commission may hold and obtain title and retain control of sites and buildings without reference to location. PURPOSE HB 3367 expands the authority of the commission to hold title to real property "statewide," outside the municipality of Austin, and reflects what is currently practiced. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repeals Section 2166.054(c), Government Code, which limits the commission to holding title to property in Austin only SECTION 2. Applies this change in law to real property or buildings acquired by the General Services Commission before, on, or after the effective date of this Act. SECTION 3. Emergency clause.
