NDT C.S.H.B. 3371 75(R)BILL ANALYSIS LICENSING & ADMINISTRATIVE PROCEDURES C.S.H.B. 3371 By: Torres 4-28-97 Committee Report (Substituted) BACKGROUND Under current law, the use of card minding devices or video bingo is limited to 30% of the sales for a bingo occasion, based on the average for the previous quarter. PURPOSE C.S.H.B. 3371 would base the cap on these devices on the average of the two past quarterly attendance reports, instead of basing the use on the reported sales. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Requires that no more than 40% of persons, based on the average attendance of the two past quarterly reports, may use card minding devices. SECTION 2. Clarifies language pertaining to a system service provider. SECTION 3. Effective date: October 1, 1997. SECTION 4. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute adds a section pertaining to bingo system service providers ability to use bar codes on bingo paper to provide accurate accounting records. The substitute also provides that a bingo system service provider shall purchase goods and services from a manufacturer licensed by the commission, and that the Lottery Commission shall include a bingo system service provider as a member of the bingo advisory committee. The substitute also amends the effective date to October 1, 1997, to comply with the quarterly reporting requirements.
