DIGEST 

Currently, the industrial district located adjacent to the Houston Ship
Channel extends 2,500 feet on either side of the channel.  However, the
site of what is currently Basis Petroleum is not included within this
district, and is instead located in the City of Houston.  Any regulation
by the City of Houston is superseded by state and federal rulemaking.
Additionally, no other refinery on the ship channel must comply with the
city's building permit requirements.  H.B. 3372 would allow the governing
body of an area previously annexed for general purposes to change the
status of an area to limited purpose annexation status for inclusion
within the industrial district. 
   
PURPOSE

As proposed, H.B. 3372 sets forth provisions regarding the authority of
certain municipalities to redesignate certain areas annexed for general
purposes. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 43.136, Local Government Code, by adding
Subsection (h), to authorize a governing body, by ordinance, to change the
status of an area previously annexed for general purposes to limited
purpose annexation status governed by this section, notwithstanding any
other law, if the area previously annexed at any time was eligible to be
included within the municipal boundaries under Subsection (b); the owners
of the area petitioning the governing body for the change in status; and
the governing body includes the area in a certain industrial district. 

SECTION 2. Emergency clause.
  Effective date: upon passage.
