BACKGROUND 

Hospital districts are set up with very specific rules that must be
changed through legislation. The law must be fine-tuned until the
operations of the board and the district are the most efficient for the
services provided to the specific region. 

PURPOSE

To make changes to the enabling legislation of the Hansford County
Hospital District. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Sections 4(b) and (c), Chapter 872, Acts of the 62nd
Legislature, to clean up language in statute, and to allow a May election
of directors. 

SECTION 2. Adds Section 4A to Chap. 872 which provides for write-in
candidacy for hospital board: name must be on list of write-in candidates,
candidate must make a declaration of write-in candidacy, which must be
filed no later than the 25th day before the election. 

SECTION 3. Amends Section 5 of Chap. 872 to make language changes and to
add ancillary health care under the authority of the board.  The board may
indemnify a person acting in their capacity as a officer, director, board
appointee, medical staff member, or employee.  The board may purchase
liability insurance to fund indemnification. 

SECTION 4.  Amends Section 6, Chap. 872 with language changes to show the
district is operated by a district manager. 

SECTION 5. Amends Section 7, Chap. 872 to add ancillary health care.

SECTION 6. Amends Section 8(b), Chap. 872 to add ancillary health care and
facilities. 

SECTION 7. Adds Section 8A to Chap. 872 which allows district to make
credit arrangements. 

SECTION 8. Amends Section 9, Chap. 872 to allow the board discretion for
facilities inside and outside the district, and over ancillary health care
facilities.  Allows the board to enter into a contract with a public or
private entity.  The board may determine terms and lease facilities or
equipment and can sell or lease real or personal property, as long as the
best interests of the district's inhabitants are served. 

SECTION 9. Amends Section 10, Chap. 872,  to raise to $10,000 the purchase
price that must be opened for a competitive bid. 

SECTION 10. Adds Section 10A to Chap. 872 to allow board to recruit,
train, and advertise for  physicians, ancillary professionals, and other
medical staff persons.  The board may spend district funds to provide day
care for staff members and for residents of the district. 

SECTION 11. Amends Section 11, Chapter 872 to allow the board to make
investments. 

SECTION 12.  Amends Section 14, Chapter 872 to make conforming changes to
citations of language. 

SECTION 13. Amends Section 15, Chapter 872 to delete provision on tax
collecting by county tax assessor-collector, allows the board to appoint a
tax assessor-collector for the district or contract for the assessment and
collection of taxes.  The district may borrow money in a limited amount. 

SECTION 14. Amends Section 17, Chapter 872 to allow patients from outside
the district to receive services. 

SECTION 15. Amends Section 18, Chapter 872 to include ancillary health
care. 

SECTION 16. Amends Section 19, Chapter 872 to require hospital services to
be provided, including ancillary. 

SECTION 17. Effective clause.  Act takes effect September 1, 1997.

SECTION 18. Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

The substitute deletes SECTIONS 1 and 2 of the original, and adds new
SECTIONS 1-18 to the substitute.
