BACKGROUND 

 Hospital districts are set up with very specific rules that must be
changed through legislation.  The law must be fine-tuned until the
operations of the board and the district are the most efficient for the
services provided to the specific region. 

PURPOSE

 To make changes to the enabling legislation of Hutchinson County Hospital
District. 

RULEMAKING AUTHORITY

 This legislation does not expressly delegate any rulemaking authority to
any state officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1: Amends Section 4.01(a), Chap. 77, Acts of the 71st Legislature
to require that 4 of the 7 directors will be elected and three will be
appointed by the county commissioners court. 

SECTION 2.  Amends Section 4.03(d), Chap. 77 to allow an appointed
director to serve more than 2 terms. 

SECTION 3.  Amends Section 4.05(a), Chap. 77 to allow candidate to file
for director's position, in accordance with the Election Code. 

SECTION 4.  Adds Section 4.055 to Chap. 77 to allow write-in voting in
elections. 

SECTION 5.  Amends Section 4.12, Chap. 77 to make administrator plural
throughout the section. 
 
SECTION 6.  Amends Section 4.14(b), Chap. 77 to specify district
administrator. 

SECTION 7.  Section 4.15, Chap. 77 to name general duties of the district
administrator. 

SECTION 8.  Amends Section 5.02, Chap. 77 to include ancillary health care.

SECTION 9.  Amends Section 5.03, Chap. 77 to include ancillary health care.

SECTION 10.  Amends Section 5.04, Chap. 77 to include ancillary health
care. 

SECTION 11.  Amends Section 5.06, Chap. 77 to include ancillary health
care and list what ancillary health care includes.  Allows the board to
acquire property and supplies for ancillary services.  Allows the board to
sell property of either the ancillary services or the district. 

SECTION 12.  Amends Section 5.07(c), Chap. 77 to make conforming changes
to existing statute. 

 SECTION 13.  Amends Section 5.08, Chap. 77 to allow the board to enter
into contracts with public or private entities for both the hospital and
the ancillary facilities. 

SECTION 14.  Amends Sections 5.11(b) and (c), Chap. 77 to make conforming
changes. 

SECTION 15.  Amends Sections 5.12(a) and (c), Chap. 77 to make conforming
changes.    The board may contract with a state agency or political
subdivision or the federal government. 
 
SECTION 16.  Amends Sections 5.13, Chap. 77 to allow service contracts
with a public or private entity, includes those outside the district. 

SECTION 17.  Adds Section 5.19 to Chap. 77 to provide for joint ownership
arrangements.  The board must determine the arrangement is in the best
interests of the district. 

SECTION 18.  Amends Section 6.05(d), Chap. 77 to specify the district
administrator and include ancillary care. 

SECTION 19.  Amends Section 6.09(b), Chap. 77 to allow investments in any
investment vehicle that is in the district's best interest and does not
violate the Texas Constitution. 

SECTION 20.  Amends Section 7.01, Chap. 77 to include equipment, and
ancillary health care. 

SECTION 21.  Amends Section 7.04(a) and (c), Chap. 77 to include ancillary
health care. 

SECTION 22.  Act takes effect immediately, with exceptions.

SECTION 23.  Emergency clause.

COMPARISION OF ORIGINAL TO SUBSTITUTE

The substitute deletes SECTIONS 1-3 of the original, and adds new SECTIONS
1-23 to the substitute.
