SLC C.S.H.B. 3465 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT C.S.H.B. 3465 By: Greenberg 4-25-97 Committee Report (Substituted) BACKGROUND Military forces in Texas have vastly different criteria for land use as compared with commercial uses. PURPOSE HB 3465 provides that the Adjutant General of the State of Texas shall determine unused or underutilized using military criteria when considering land utilized for military purposes. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends 431.030, Gov. Code, is amended by adding (e) as follows: (e) States that the adjutant general shall identify property designated for military use by this state that is not being used or is being substantially underused and submit a report identifying the real property to the GLO for review. SECTION 2. Amends Sec. 31.156, Natural Resources Code, by amending (b) and (c) and adding (d) as follows: (b) States that except as provided by (c), the division shall identify the property not being used or being substantially underused. (c) States that division is not required to identify property as required by (b) if the property is designated for military use by this state. Additionally, if the adjutant general identifies the property as not being used or being underused, the division shall make recommendations to the commissioner regarding the use of the property or a real estate transaction involving the property. (d) The division shall submit to the commissioner information to the evaluation of a real estate transaction involving the property and lease potential of the property. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE CSHB 3465 inserts new language in SECTION 1. that amends Sec. 431.030, Gov. Code, by adding (e). The original legislation did not contain any such provision. CSHB 3465 in SECTION 2. amends Sec. 31.156, Natural Resources Code, by amending (b) and (c) and adding (d). The original legislation only amended Sec. 31.156(b), Natural Resources Code.
