This bill sets forth provisions regarding the disposition of certain state property designated for military use. PURPOSE As proposed, H.B. 3465 sets forth provisions regarding the disposition of certain state property designated for military use. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 431.030, Government Code, by adding Subsection (e) and (f), to require the adjutant general to produce a report evaluating the military use of any real property under the management and control of the adjutant general's department or the Texas National Guard Armory Board. Requires the adjutant general to evaluate the use of the property as required by this subsection according to military criteria for use of real property. Requires the adjutant general to submit a preliminary report of the report required under Subsection (e) to the commissioner of the General Land Office (commissioner) identifying the real property used for military purposes. Requires the adjutant general to submit a report by a certain date to certain public officials. SECTION 2. Amends Section 31.156, Natural Resources Code, by adding Subsection (d), to require the asset management division of the General Land Office (division) to notify the adjutant general's department before the division begins the evaluation of property under the management of control of the adjutant general's department or the Texas National Guard Armory Board. SECTION 3. Amends Section 31.157, Natural Resources Code, by amending Subsection (d) and adding Subsection (e), to prohibit the commissioner from recommending a real estate transaction involving certain real property in the final report submitted as provided by Subsection (e). Makes a conforming change. SECTION 4. Emergency clause. Effective date: upon passage. SUMMARY OF COMMITTEE CHANGES SECTION 1. Amends Section 431.030, Government Code, by deleting proposed Subsection (e) and adding new Subsections (e) and (f) , to set forth provisions for the adjutant general regarding the evaluation and reporting on certain real property used for military purposes. SECTION 2. Amends Section 31.156, Natural Resources Code, by deleting proposed Subsections (a)-(c) and adding new Subsection (d), to require the division to notify the adjutant general's department before the division begins the evaluation. SECTION 3. Amends Section 31.157, Natural Resources Code, by deleting proposed Subsections (b) and (c), and amending Subsection (d) and adding Subsection (e) to prohibit the commissioner from recommending a real estate transaction involving certain real property in the final report submitted as provided by Subsection (e). Adds new SECTION 4 to set forth the emergency clause and the effective date.
