DIGEST 

Currently, there is no time limit on fundraising and installation for
monuments on the Capitol grounds.  There are concerns that limited space
on the Capitol grounds may disqualify worthwhile proposals by groups that
cannot raise the required funds in a timely manner.  This bill imposes a
four-year time limit for fundraising and installation for new monuments on
the Capitol grounds.  

PURPOSE

As proposed, H.B. 3517 sets forth provisions regarding the approval of
monuments on the grounds of the State Capitol. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 443, Government Code, by adding Section 443.015,
as follows: 

Sec.  443. 015.  CAPITOL GROUNDS MONUMENTS.  Prohibits the State
Preservation Board (board) from approving the installation of a permanent
monument on the grounds  of the Capitol under the jurisdiction of the
board, and erection or construction of an approved monument may not begin,
unless certain conditions are satisfied. Provides that installation by a
certain date is a condition of the board's approval, and if installation
is not completed by that date the board's approval of the monument is
considered withdrawn and the monument may not be installed.  Defines
"monument." 

SECTION 2. Provides that this Act applies to monuments approved by the
board before the effective date of this Act.  Requires the installation of
a monument approved by the board to be completed not later than the fourth
anniversary of the effective date of this Act or the board's approval of
the monument is considered withdrawn and the monument may not be
installed. 

SECTION 3. Emergency clause.
  Effective date:  upon passage.
