SDC H.B. 3517 75(R) BILL ANALYSIS HOUSE ADMINISTRATION H.B. 3517 By: Goolsby 4-11-97 Committee Report (Unamended) BACKGROUND For proposed monuments on the grounds of the state capitol, there are currently no limits on the time allowed to erect the monument. Since approved monuments have space reserved for them on the grounds in perpetuity, some problems have occurred when organizations responsible for building these structures are unable to raise the necessary funds or other unforeseen problems occur that prevent the completion of the project. Space for monuments is certainly limited and there should be opportunity for other monuments to be constructed if others fail to be built after several years. PURPOSE HB 2185 would establish a four-year time line for the construction of approved monuments on the capitol grounds. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1: Chapter 443, Government Code is amended by adding Section 443.015. Section 443.015. CAPITOL GROUNDS MONUMENTS. (a)The State Preservation Board, under their jurisdiction, may deny the installation of a monument on the grounds of the capitol if they determine that the monument will not be completed within four years of its approval date. Completion in this time frame will be a condition of approval by the board. After the four year deadline, the monument may not be installed. (b)Defines "monument". SECTION 2: Effective date.
