BACKGROUND 

The City of Austin will be opening the Austin Bergstrom International
Airport and closing the Mueller Airport, therefore it will be necessary
for the State Aircraft Pooling Board to relocate to the new airport. 

PURPOSE

House Bill 3585 authorizes the General Services Commission to convey
state-owned property at Robert Mueller Airport to the City of Austin.  The
bill also provides that the proceeds from the sale shall be used by the
General Services Commission for relocating operations of the State
Aircraft Pooling Board from Mueller Airport to the Austin Bergstrom
International Airport. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. (a) States that the General Services Commission may convey the
state's interest in the real property described in subsection (e) of this
section to the City of Austin. 

 (b) States that the purchase and sale agreement relating to the
conveyance authorized by this section: 
  (1) shall require the City of Austin to pay cash consideration in an
amount that is equal to at least the fair market value of the real
property as determined by an appraisal performed by the General Land
Office; and 

  (2) may require other terms and conditions negotiated by the General
Services Commission and the City of Austin. 

 (c) The General Services Commission may transfer the real property only
by a special warranty deed. 

 (d) Section 31.158, Natural Resources Code, does not apply to the
conveyance authorized by this section. 

 (e) The real property is described alternatively as:

  (1) a 20.206 acre parcel described as Lots 1-2, Block A, Lots 1-11,
Block B, Lots 1-3, Block C, Wilbarger Place, Section One, City of Austin,
Travis County , Texas; and 

  (2) 20.206 acres situated in the Henry Warnell Survey, Abstract Number
793, and in the Joseph Burleson Survey, Abstract Number 62, in the City of
Austin, Travis County, Texas. 

SECTION 2. States that the proceeds from the conveyance shall be used only
by the General Services Commission for relocating operations of the State
Aircraft Pooling Board from Mueller  Airport to Bergstrom Airport. 

SECTION 3. Emergency Clause. Effective Date.
