DIGEST 

Last session, legislation made changes to the Water Code.  However, the
legislation has led to some confusion for water districts as to which law
governs.  This bill provides regulations regarding election to the board
of supervisors of the Clear Creek Drainage District of Galveston County. 

PURPOSE

As proposed, H.B. 3586 provides regulations regarding election to the
board of supervisors of the Clear Creek Drainage District of Galveston
County. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 3, Article 8280-285, V.T.C.S., to require
members of the board of supervisors of the Clear Creek Drainage District
of Galveston County (board) to hold office for staggered terms of four
years, rather than two years.  Requires an election to be held on the
first Saturday in May, rather than in April, in each even-numbered year.
Requires the remaining supervisors to make an appointment to fill the
unexpired term if a vacancy occurs on the board, except as provided by
Subsection (c).  Sets forth procedures to be followed if a vacancy occurs
on or before the 65th day before the general election for supervisors held
in the next-to-last evennumbered year of a term of office.  Deletes
existing text regarding the terms of certain supervisors. 

SECTION 2. Sets forth regulations regarding supervisors serving on the
board of the Clear Creek Drainage District of Galveston County. 

SECTION 3. Emergency clause.
  Effective date: upon passage.
