SLC H.B. 3600 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 3600 By: Uher 5-2-97 Committee Report (Unamended) BACKGROUND Current Texas law allows municipalities to use powers of eminent domain to acquire public or private property. PURPOSE HB 3600 will limit the ability of a municipality to exercise the right of eminent domain, if the purpose of acquiring the property is for economic development. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Sec. 251.001, Local Government Code, is amended by adding (c) as follows: (c) A municipality may not exercise the right of eminent domain to acquire public or private property for the purpose of promoting economic development in the municipality if the purpose of the economic development of the property to be acquired is to establish a business enterprise that sells goods at retail.
