BWH H.B. 3610 75(R) BILL ANALYSIS COUNTY AFFAIRS H.B. 3610 By: Williams/Rabuck 5-12-97 Committee Report (Unamended) BACKGROUND The vast majority of hospital districts in the state give their voters the right to dissolve the district on petition; However, the voters of the Montgomery County Hospital District do not have that right. This legislation simply conforms the Montgomery County Hospital District to the majority of hospital districts in the state. PURPOSE HB 3610 gives the voters of the Montgomery County Hospital District the right to vote on dissolution of the district, upon petition of 15% of the district's registered voters. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 258, Acts of the 65th Legislature, Regular Session, 1977, by adding Sections 23A and 23B requiring the Board of Directors to hold an election on the dissolution of the district upon petition by 15% of the registered voters. The Board shall maintain control of the district until all debts have been paid or settled. The Board shall also determine the debt owed by the district and impose a tax on property in the district in proportion of the debt to the property value. SECTION 2. Emergency clause.
