SRC-MAX H.C.R. 26 75(R) BILL ANALYSIS Senate Research Center H.C.R. 26 By: Maxey (Ratliff) Finance 5-17-97 Engrossed DIGEST The Burnett Companies, doing business as Burnett Personnel Services, has made certain allegations. H.C.R. sets forth provisions regarding these allegations. PURPOSE As proposed, H.C.R. 26 submits the following resolutions: That the Burnett Companies, doing business was Burnett Personal Services, is granted permission to sue the State of Texas and the Texas Department of Banking on all claims related to the indemnity agreement and the accident involving Cedric Tasby that occurred on November 9, 1994, subject to Chapter 107, Civil Practices and Remedies Code. Requires the suit authorized by this resolution to be brought in Travis County. Prohibits the total of all damages awarded in this suit authorized by this resolution, including any court costs, attorney's fees, and prejudgments interest under law from exceeding $16,000, and that The Burnett Companies may not plead an amount in excess of that amount in a suit authorized by this resolution. That the banking commissioner of Texas be served process as provided by Section 107.002(a)(3), Civil Practice and Remedies Code.
