BACKGROUND 

Currently, Texas law allows counties with a population of 250,000 
or more to enact fire codes.  
Many counties are experiencing rapid growth.  Because of the 
growth, there is concern as to whether 
counties will need the ability to establish and enforce fire 
codes in developing areas.  S.B. 10 would 
authorize a county adjacent to a county with a population of over 
250,000 to adopt a fire code and 
rules necessary to administer and enforce the fire code.

PURPOSE

As proposed, S.B. 10 outlines provisions regarding the authority 
of certain counties to adopt and 
enforce a fire code.

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a 
state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 235.001(a), Local Government Code, to 
authorize the commissioners 
court of a county with a population of over 250,000 or a county 
adjacent to a county with a 
population of over 250,000 to adopt a fire code and rules 
necessary to administer and enforce the fire 
code. 

SECTION 2. Emergency clause.
  Effective date: upon passage.
