SRC-JRN S.B. 25 75(R) BILL ANALYSIS Senate Research Center S.B. 25 By: Truan State Affairs 5-6-97 As Filed DIGEST Currently, there is no provision that relates to certain previously waived service credit in the Employees Retirement System of Texas. Persons who have served the appropriate amount of time in the state legislature are not automatically qualified to receive state retirement benefits. This bill qualifies certain individuals for state retirement benefits, provided the individuals deposit the necessary funds in the Employees Retirement System of Texas to comply with state retirement system requirements. PURPOSE As proposed, S.B. 25 qualifies certain individuals for state retirement benefits, provided the individuals deposit the necessary funds in the Employees Retirement System of Texas, to comply with state retirement system requirements. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 813E, Government Code, by adding Section 813.406, as follows: Sec. 813.406. CERTAIN PREVIOUSLY WAIVED SERVICE. Authorizes certain persons meeting certain requirements to establish service credit in the Employees Retirement System of Texas (retirement system) for the person's state legislative service before September 1, 1998. Authorizes a person to establish credit under this section by depositing a certain computed contribution amount with the retirement system in a lump sum. Provides that this section expires September 1, 1998. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
