SGN S.B. 67 75(R)BILL ANALYSIS CORRECTIONS S.B. 67 By: Moncrief (Gallego) 4-30-97 Committee Report (Unamended) BACKGROUND Currently, the Texas Department of Criminal Justice (TDCJ) has the statutory authority to bypass purchasing procedures developed under the State Purchasing and General Services Act and directly purchase certain items for agricultural or industrial production. The Department ceased utilizing this purchasing practice in Spring of 1996. PURPOSE As proposed, S.B. 67 eliminates the direct purchasing authority and reinstates the purchasing procedures set forth in the State Purchasing and General Services Act. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 496.051, Government Code, by deleting existing Subsections (a) and (b), which allowed the institutional division to purchase directly certain items if the division determined that the purchase was economically feasible and advantageous to the division. Maintains language requiring the department to comply with any special purchasing procedures requiring competitive review under the State Purchasing and General Services Act. Recodifies the State Purchasing and General Services Act (Article 601b, V.T.C.S.) as Subtitle D, Title 10, Government Code. SECTION 2. Emergency clause.
