SRC-MAX S.B. 67 75(R) BILL ANALYSIS Senate Research CenterS.B. 67 By: Moncrief Criminal Justice 2-21-97 As Filed DIGEST Currently, the Texas Department of Criminal Justice (TDCJ) has the authority to bypass purchasing procedures developed under the State Purchasing and General Services Act and maintains the practice of direct purchasing authority. S.B. 67 would abolish the use of TDCJ's direct purchasing authority and reinstate the purchasing procedures set forth in the State Purchasing and General Services Act. PURPOSE As proposed, S.B. 67 reinstates the purchasing procedures set forth in the State Purchasing and General Services Act and makes recodification changes. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 496.051, Government Code, by deleting existing Subsections (a) and (b), requiring the Texas Department of Criminal Justice (department) to comply with any special purchasing procedures requiring competitive review under the State Purchasing and General Services Act. Recodifies the State Purchasing and General Services Act (Article 601b, V.T.C.S.) as Title 10D, Government Code. SECTION 2. Emergency clause. Effective date: upon passage
