DIGEST 

Currently, Texas law does not authorize the Bayview Municipal Utility
District of Galveston County to install and assess taxes for street
lighting.  This bill authorizes the district to install, operate,
maintain, and assess taxes for street lighting. 

PURPOSE

As proposed, C.S.S.B. 92 authorizes to the Bayview Municipal Utility
District of Galveston County to install, operate, and maintain street
lighting and to assess costs for those functions against the district's
customers. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article 8280-287, V.T.C.S., by adding Section 2A, as
follows: 

Sec. 2A.  Authorizes the Bayview Municipal Utility District of Galveston
County (district) to install, operate, and maintain lighting within a
public utility easement or public right-ofway inside the district's
boundaries. Authorizes the district to assess the cost of installing,
operating, and maintaining the street lighting as an additional charge in
the monthly billings of the district's customers.  Provides that this
section does not authorize the district to install, operate, or maintain
street lighting on a right-of-way that is part of the designated state
highway system. 

SECTION 2.  Effective date: September 1, 1997.

SECTION 3.  Emergency clause. 

SUMMARY OF COMMITTEE CHANGES

Amends SECTION 1, Article 8280-287, V.T.C.S.,  to authorize the district
to assess its costs against the district's customers, rather than abutting
property owners.  States that the district is not authorized to install,
operate, or maintain street lighting on a right-of-way that is designated
part of the state highway system.
