SRC-HRD S.B. 104 75(R) BILL ANALYSIS Senate Research CenterS.B. 104 By: Nelson State Affairs 2-3-97 As Filed DIGEST Currently, Texas law does not place any restrictions upon former legislators in regard to lobbying activities. This bill would prohibit legislators from engaging in lobbying until two years after leaving office. PURPOSE As proposed, S.B. 104 prohibits former members of the legislature from engaging in certain activities for two years after leaving office. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 572C, Government Code, by adding Section 572.059, as follows: Sec. 572.059. PROHIBITED ACTIVITIES OF FORMER LEGISLATORS. Prohibits a former member of the legislature from engaging in activities that require registration under Chapter 305, Government Code, before the second anniversary of the date the former member ceased to be a member. Provides that a former member commits a Class A misdemeanor if the former member intentionally or knowingly violates Subsection (a). SECTION 2. Effective date: January 31, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
