MMA S.B. 109 75(R) BILL ANALYSIS HIGHER EDUCATION S.B. 109 By: Haywood (Chisum) 2-12-97 Committee Report (Unamended) BACKGROUND Currently, the Pampa Independent School District (ISD) is serviced by the Borger Junior College District due to legislation passed during the 74th Legislature which divided the state into 50 junior college district service areas. The bill geographically defined the service areas based on the territories within the college's taxing district and surrounding territories that received services from the college but were not located in its taxing district. Under its provisions, Pampa ISD was inadvertently placed in the Borger Junior College District Service Area while the remainder of Gray County was put in the Clarendon College District Service Area. PURPOSE As proposed, S.B. 109 includes Gray County among the list of counties serviced by the Clarendon College District, rather than by the Borger Junior College District. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 130.169 and 130.173, Education Code, as follows: Sec. 130.169. Is amended by deleting language which includes the territory within the Pampa Independent School District located in Gray County among the list of areas serviced by the Borger Junior College District. Sec. 130.173. Is amended by deleting the exception of the Pampa Independent School District area in Gray County from list of areas serviced by the Clarendon College District Service Area. Makes a conforming change. SECTION 2. Emergency clause.
