JLM S.B. 138 75(R) BILL ANALYSIS PUBLIC EDUCATION S.B. 138 By: Bivins (Sadler) 5-20-97 Committee Report (Unamended) BACKGROUND Currently, a child is exempt from the requirements of compulsory school attendance if the child is expelled from school. This legislation allows such an exemption only in those school districts that do not participate in a juvenile justice alternative education program (JJAEP). This will enable the juvenile authorities to use the compulsory attendance laws to help ensure attendance at the JJAEP. PURPOSE As proposed, S.B. 138 establishes an exemption from mandatory public school attendance requirements in certain expulsion cases. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 25.086(a), Education Code, to provide that a child is exempt from the requirements of compulsory school attendance if the child is expelled in accordance with the requirements of law in a school district that does not participate in a juvenile justice alternative education program under Section 37.011. SECTION 2. Provides that this Act applies beginning with the 1997-1998 school year. SECTION 3. Emergency clause. Effective date: upon passage.
