Over 26 states are evaluating the need for post-tenure review programs in order to review the performance of all tenured faculty. C.S.S.B. 149 sets forth terminology and outlines provisions for the establishment of a post-tenure evaluation process at certain institutions of higher education. PURPOSE As proposed, C.S.S.B. 149 sets forth provisions and terminology relating to the post-tenure evaluation process at certain institutions of higher education. RULEMAKING AUTHORITY Rulemaking authority is granted to each governing board of an institution of higher education under SECTION 1 (Sec. 51.941(b), Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 51Z, Education Code, by adding Section 51.941, as follows: Sec. 51.941. POST-TENURE REVIEW. Defines "governing board" and "institution of higher education." Requires each governing board of an institution of higher education to adopt rules providing for a periodic post-tenure evaluation process for all faculty tenured at the institution. Outlines provisions concerning the post-tenure evaluation process at an institution of higher education. Prohibits a governing board from waiving the evaluation process for any faculty member granted tenure at an institution. Requires each governing board to file a copy of the rules adopted pursuant to this section, and any amendments to such rules, with the Texas Higher Education Coordinating Board by September 1 of each year. SECTION 2. Requires the rules adopted by a governing board of an institution of higher education pursuant to the provisions of this Act to provide for the post-tenure evaluation not later than January 1, 2004, of each faculty member tenured at the institution as of the effective date of this Act. SECTION 3. Effective date: January 1, 1998. SECTION 4. Emergency clause. SUMMARY OF COMMITTEE CHANGES Amends SECTION 1 Chapter 51Z, Education Code, to Section 51.941(c) regarding post-tenure review.
