This bill reestablishes a separate advisory committee to the Texas Workforce Commission on apprenticeship and job training issues. S.B. 154 sets forth the duties and responsibilities for the apprenticeship and training advisory committee. PURPOSE As proposed, S.B. 154 reestablishes a separate advisory committee on apprenticeship related issues within the Texas Workforce Commission. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 133.001, Education Code, by amending Subdivision (5) and by adding Subdivisions (7) and (8) to define "advisory committee" and "executive director." Makes a conforming change. SECTION 2. Amends Chapter 133, Education Code, by adding Sections 133.010 and 133.011, as follows: Sec. 133.010. APPRENTICESHIP AND TRAINING ADVISORY COMMITTEE. Sets forth the composition of the apprenticeship and training advisory committee (committee). Requires certain persons to serve as nonvoting members in addition to the voting members appointed under Subsection (a). Prohibits a person from being eligible for appointment as a member of the committee if the person is required to register with the secretary of state under Chapter 305, Government Code. Sets forth the time period regulations for voting members, public members, and other nonvoting members. Provides that a vacancy in a position on the committee is required to be filled in the same manner in which the position was originally filled by a person who meets the qualifications of the vacated position. Sec. 133.011. POWERS AND DUTIES OF ADVISORY COMMITTEE. Requires the committee to recommend and evaluate a statewide plan for the development of a comprehensive program of apprentice training. Authorizes the executive director of the committee to designate additional duties to be performed by the advisory committee. Sets forth the meeting and compensatory requirements for the advisory committee and its members. Provides that the advisory committee is not subject to Article 6252-33, V.T.C.S. SECTION 3. Amends Section 2308.102(c), Government Code, to conform to Section 11.17, Chapter 655, Acts of the 74th Legislature, Regular Session, 1995, and to provide that the Texas Council on Economic and Workforce Competitiveness is no longer required to assume the responsibilities of the technical advisory committee to the State Occupational Information Coordinating Council and the Apprenticeship and Training Advisory Committee. SECTION 4. Repealer: Section 11.17, Chapter 655, Acts of the 74th Legislature, Regular Session, 1995 (Workforce and Economic Competitiveness Act). SECTION 5. Provides that a person who served as a member of the Apprenticeship and Training Advisory Committee, as the committee previously existed under Section 19, Chapter 771, Acts of the 73rd Legislature, Regular Session, 1993, is eligible for the appointment to the apprenticeship and training advisory committee as created under Chapter 133, Education Code, as added by this Act. Requires the executive director of the Texas Workforce Commission to appoint as members two persons who represent employers of members of apprenticible trades, two persons who represent bargaining agents for members of apprenticible trades, two persons who are employed as training directors or program administrators, and one person employed by a public school or state postsecondary educational institution for terms expiring February 1, 2000. Requires the balance of the initial voting members to be appointed for terms expiring February 1, 2002. Provides that the initial public member of the advisory committee who is designed by the commissioner of education serves a term expiring February 1, 2000. SECTION 6. Effective date: September 1, 1997. SECTION 7. Emergency clause.
