SRC-SLL S.B. 185 75(R) BILL ANALYSIS Senate Research CenterS.B. 185 By: Shapiro Criminal Justice 1-24-97 As Filed DIGEST Currently, Texas law does not make it an offense for a person to force the mouth of a child to contact the anus or sexual organ of another person. Current law addresses only penetration, which would not include such acts as a male defendant's sexual organ touching the lips of a child or a child's mouth being placed on a female defendant's sexual organ. This bill will make it an offense for a person to knowingly or intentionally cause the mouth of a child to contact the anus or sexual organ of another person. PURPOSE As proposed, S.B. 185 creates an offense for a person to knowingly or intentionally cause the mouth of a child to contact the anus or sexual organ of another person. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.011(a), Penal Code, to provide that a person commits an offense if the person intentionally or knowingly causes the mouth of a child to contact the anus or sexual organ of another person, including the actor. SECTION 2. Amends Section 22.021(a), Penal Code, to make a conforming change. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause.
