DIGEST 

Currently, no legislation exists for the beautification and improvement of
county parks.  This bill provides for the participation in a program
dedicated to beautification and improvement of county parks. 

PURPOSE

As proposed, S.B. 195 creates and sets guidelines for the County Park
Beautification and Improvement Program Act. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. SHORT TITLE.  Requires this Act to be known as and may be cited
as the County Park Beautification and Improvement Program Act. 

SECTION 2. PURPOSE; CREATION.  Provides that the intent of the legislature
is that each county dedicating land for use as county parks maintain and
beautify the parks through certain measures. Establishes the County Park
Beautification Program (program). 

SECTION 3. IMPLEMENTATION.  Authorizes a county commissioners court
(court) to elect to participate in the program by majority vote.  Requires
the court to designate a person in the division of the county government
as coordinator of the program.  Authorizes the coordinator to solicit
advice and assistance from state and county agencies and private
organizations in developing and implementing the program. 

SECTION 4. REPORT; ADOPTION.  Requires the coordinator to report findings
and to recommend an implementation strategy to the court.  Requires the
court to reject or accept the strategy, and state reasons for rejection.
Requires the  the coordinator to adopt new strategy within six months if
the strategy is rejected.  Authorizes the court to fund the program as
provided in Section 5 of this Act. 

SECTION 5. FUNDING.  Sets forth funding requirements for a county
commissioners court electing to participate in the program. 

SECTION 6. Emergency clause.
  Effective date: upon passage.
