SRC-JRN S.B. 209 75(R) BILL ANALYSIS Senate Research CenterS.B. 209 By: Haywood Intergovernmental Relations 2-18-97 As Filed DIGEST Currently, S.B. 753, enacted in 1987, created the Lake Ray Roberts Planning and Zoning Commission (commission). However, on some occasions, the commission is unable to establish a quorum for official business, and the city of Sanger, which resides in the extraterritorial jurisdiction of the county, was inadvertently excluded in the composition of the commission. This bill allows each mayor of the surrounding lake area in the county to be included in the composition of the commission, and allows each member of the commission to appoint a representative to act on his or her behalf at official meetings of the commission. PURPOSE As proposed, S.B. 209 allows each mayor of the surrounding lake area in the county to be included in the composition of the Lake Ray Roberts Planning and Zoning Commission and allows each member of the commission to appoint a representative to act on their behalf at official meetings of the commission. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 231.107, Local Government Code, by establishing requirements for appointment by a county judge or county commissioner to a lake planning commission of lakes Tawakoni and Ray Roberts (commission) for persons living in affected precincts. Requires the commission to include the mayor of each municipality the territory or extraterritorial jurisdiction of which includes any part of the lake area in the county. Authorizes a mayor serving on the commission to designate another person to serve in place of the mayor at one or more commission meetings. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
